1. Parties and Scope
These Terms and Conditions govern the use of the website www.vipemlak.com and the VipEmlak mobile application, both operated by VIPEMLAK Turizm İnşaat Ticaret Ltd. Şti. (“VipEmlak”). By using the website or the app you accept these terms. If you do not accept them, please do not use our services.
2. Definitions
- Platform: the www.vipemlak.com website and the VipEmlak mobile application
- User: any natural or legal person visiting or using the Platform
- Listing: a property advertisement published on the Platform
- Agent: a property consultant working for VipEmlak
3. Nature of the Service
VipEmlak provides brokerage services for property sales, purchases and rentals. Listings published on the Platform are not binding offers but invitations to treat. Any sale, purchase or rental is concluded only through a separate agreement signed between the parties.
4. User Obligations
When using the Platform, the User agrees:
- that the information provided is accurate, current and their own,
- not to act contrary to applicable law or public morals,
- not to interfere with the operation of the Platform, overload it or compromise its security,
- not to harvest Platform content in bulk using automated tools (bots, scrapers, etc.),
- not to infringe the rights of other users.
In case of breach, VipEmlak reserves the right to restrict or terminate access without prior notice.
5. Accuracy of Listings and Limitation of Liability
Prices, floor areas, room counts, locations, title deed status and images shown in listings are based on statements provided by property owners. While VipEmlak checks this information with reasonable care, it does not guarantee that it is complete or up to date. Prices and availability may change without notice and a listing may already have been withdrawn.
Users are advised to inspect the property in person and review the title deed records before entering into any agreement. VipEmlak cannot be held liable for indirect damages arising from factual errors, typographical errors or delays in updating listing information.
6. Intellectual Property
All text, images, logos, designs and software on the Platform belong to VipEmlak or its licensors. This content may not be copied, reproduced, distributed or used commercially without VipEmlak’s written permission.
7. Use of the Mobile Application
The VipEmlak mobile application is provided free of charge. The User is granted a non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes. Reverse engineering, decompiling or modifying the app is prohibited. Any mobile data charges incurred while using the app are borne by the User.
8. Service Availability
VipEmlak takes reasonable care to provide the Platform without interruption or error; however, the User accepts that temporary interruptions may occur due to maintenance, updates, technical faults or force majeure. VipEmlak reserves the right to modify the content and features of the Platform without prior notice.
9. Protection of Personal Data
How your personal data is processed is explained in detail in our Privacy Policy, which forms an integral part of these Terms and Conditions.
10. Third-Party Links
The Platform may contain links to third-party websites. VipEmlak is not responsible for the content or privacy practices of those sites.
11. Changes to These Terms
VipEmlak may amend these Terms and Conditions unilaterally. The current text takes effect as soon as it is published on this page. Continued use of the Platform means you accept the updated terms.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Erdemli / Mersin shall have jurisdiction over any dispute. For users qualifying as consumers, Consumer Arbitration Committees and Consumer Courts are also competent within the monetary limits set by applicable legislation.
13. Effective Date
These Terms and Conditions take effect between the parties from the moment you begin using the Platform.
